Refund & Returns Policy – Vapor Club

1. GENERAL POLICY

Vapor Club is committed to complying with all applicable South African consumer protection laws, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

Due to the nature of our products, all sales are considered final once delivered, except where otherwise required by law. Refunds, returns, replacements, or exchanges will only be considered where legally required and where all conditions contained in this policy have been met.

By placing an order with Vapor Club, the customer acknowledges that they have read, understood, and accepted this Refund & Returns Policy.


2. AGE RESTRICTION

Vapor Club sells products intended solely for adults aged 18 years and older.

By purchasing from Vapor Club, the customer confirms that:

  • They are at least 18 years of age.
  • They are legally permitted to purchase vaping-related products in their jurisdiction.
  • All information provided during checkout is accurate and truthful.

Vapor Club reserves the right to refuse, cancel, or refund any order where age verification cannot be completed or where there is reason to believe the purchaser is under the age of 18.


3. NO CHANGE-OF-MIND RETURNS

Subject to applicable South African law, Vapor Club does not accept returns, exchanges, or refunds based on:

  • Change of mind
  • Personal preference
  • Taste or flavour preference
  • Product expectations not being met
  • Dissatisfaction after use
  • Incorrect product selection by the customer
  • Customer ordering the wrong item

Customers are responsible for ensuring that the products they purchase are suitable for their intended use before completing their order.


4. HYGIENE, SAFETY & HEALTH EXCLUSION

Due to health, safety, and hygiene considerations, Vapor Club does not accept returns, exchanges, or refunds for any product that has been:

  • Opened
  • Used
  • Tested
  • Charged
  • Activated
  • Filled
  • Tampered with
  • Damaged after delivery

This policy applies regardless of the duration or extent of use.

Products that have been removed from their original sealed packaging may not be eligible for return unless proven to be defective upon delivery.


5. DEFECTIVE GOODS (SECTION 56 – CPA)

In accordance with Section 56 of the Consumer Protection Act, customers may return goods that are:

  • Defective
  • Unsafe
  • Not of acceptable quality

Provided that:

  • The defect existed at the time of delivery;
  • The product was used in accordance with its intended purpose;
  • The product has not been altered, modified, mishandled, or damaged after delivery;
  • The claim is made within six (6) months of delivery.

Upon inspection and verification of a valid defect claim, Vapor Club may provide one of the following remedies as required by law:

  • Repair
  • Replacement
  • Refund

Vapor Club reserves the right to inspect, test, and verify all alleged defects before approving any remedy.


6. ONLINE PURCHASE CANCELLATIONS (ECTA)

In accordance with Section 44 of the Electronic Communications and Transactions Act, customers may have the right to cancel certain online purchases within seven (7) days of receiving the goods.

This right does not apply to:

  • Opened products
  • Used products
  • Hygiene-sensitive products
  • Products with broken seals
  • Products not returned in their original condition
  • Products missing packaging, accessories, or components

Where cancellation is legally valid:

  • Products must be returned unused and unopened.
  • Customers are responsible for all return shipping costs.
  • Original shipping fees are non-refundable.
  • Products remain the customer's responsibility until received by Vapor Club.

7. STRICT RETURN REQUIREMENTS

To qualify for any return where legally applicable, products must:

  • Be unused and unopened;
  • Be in their original packaging;
  • Include all accessories, manuals, and components;
  • Be accompanied by proof of purchase;
  • Be returned within the applicable legal timeframes;
  • Be approved by Vapor Club prior to being returned.

Returns that fail to satisfy all requirements may be refused.


8. NON-RETURNABLE PRODUCTS

Unless defective upon delivery, the following products are non-returnable:

  • Disposable vapes
  • Opened refill devices
  • Opened pods or cartridges
  • Opened accessories
  • Nicotine pouches
  • Promotional items
  • Free gifts
  • Clearance items
  • Bundle items sold as part of a package
  • Products damaged through misuse or neglect

9. ORDER CANCELLATIONS

Orders may only be cancelled before dispatch.

Once an order has been packed, processed, shipped, or collected by a courier, cancellation requests may be refused.

Vapor Club reserves the right to deduct any payment processing, administration, or courier costs incurred before issuing an approved refund.


10. REFUND PROCESSING

Approved refunds will be processed using the original payment method used for the purchase.

Refunds may take between 7–14 business days to reflect, depending on the customer's bank or payment provider.

Vapor Club shall not be liable for delays caused by financial institutions, payment gateways, or third-party service providers.


11. PRODUCT USE DISCLAIMER

Vapor Club products are intended for adult use only.

Customers acknowledge that:

  • Products are used entirely at their own risk.
  • Vapor Club does not provide medical advice.
  • Vapor Club makes no medical, therapeutic, smoking cessation, health, or wellness claims.
  • Customers are solely responsible for determining whether a product is appropriate for their personal use.

Customers should consult a qualified healthcare professional if they have concerns regarding the use of vaping products.


12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Vapor Club shall not be liable for:

  • Personal injury
  • Illness
  • Allergic reactions
  • Misuse of products
  • Indirect damages
  • Consequential damages
  • Loss of income
  • Loss of profits
  • Loss arising from delayed delivery
  • Damages resulting from failure to follow product instructions

Nothing in this policy excludes any rights that cannot legally be excluded under South African law.


13. FRAUD PREVENTION

Vapor Club reserves the right to refuse refunds, replacements, returns, or warranty claims where fraud, abuse, chargeback misuse, false claims, or suspicious activity is suspected.

Evidence may be requested, including photographs, videos, proof of purchase, and product inspection.


14. RETURNS REQUESTS

All return requests must be submitted in writing and approved by Vapor Club before any product is returned.

Unauthorised returns will not be accepted.
